Modelo 347 is not for paying anything. It is a list you hand in every February of the clients and suppliers with whom, adding up the whole year, you went over €3.005,06. Hacienda, the Spanish tax agency, uses it to cross-check what you declare with what they declare: if you say you sold €5.000 to a company, it expects to see that purchase in their books. It is one of the annual returns in autónomo taxes in Spain, the guide with the rest of the calendar.
Here is who files it, how the threshold is counted, which transactions are left out, what data it carries and what happens if you miss the deadline. Each rule comes from Real Decreto 1065/2007 (articles 31 to 35) and from Orden EHA/3012/2008, which approves the form.
Who files modelo 347
Business owners and professionals, whether individuals or companies, who carried out transactions for more than €3.005,06 with any person or entity during the year file it (articles 31 and 33.1 of Real Decreto 1065/2007).
Who does not have to file it
- Anyone who does not exceed €3.005,06 with anybody in the year (article 32.c).
- Anyone with only excluded transactions, such as those listed below (article 32.d).
- Anyone under módulos in IRPF who is also in the simplified IVA scheme, the farming scheme or the recargo de equivalencia (the retail equivalence surcharge), except for transactions they invoice. In the simplified scheme, purchases recorded in the received invoices book are also included (article 32.b).
- Anyone who keeps their IVA (Spanish VAT) books through the Agencia Tributaria's website, the system known as SII (article 32.e).
- Anyone who has neither their business seat, a permanent establishment nor their tax address in Spain (article 32.a).
The €3.005,06 threshold: how it is counted
The threshold is checked person by person and year by year: you add up all transactions with the same client or supplier during the calendar year (article 33.1). Sales and purchases are counted separately. If a company is both your client and your supplier, it can appear twice: under key B for your sales and under key A for your purchases, each if it exceeds €3.005,06 (annex II of Orden EHA/3012/2008).
The Agencia Tributaria states that the amount is counted including IVA.
An example. You run a carpentry business under estimación directa and invoice a company €1.000 plus IVA in March and €2.000 plus IVA in November. Including IVA they add up to €3.630, so that company goes in your modelo 347 under key B. In the quarterly breakdown you enter €1.210 in the first quarter and €2.420 in the fourth.
Which transactions are left out
Even if you exceed the threshold, these are not declared (article 33.2):
- Transactions for which you did not have to issue an invoice or did not have to include the client's details, such as many retail sales with a simplified invoice that does not identify the buyer.
- Those outside your business.
- Free supplies and services that are not subject to or exempt from IVA.
- IVA-exempt rentals by individuals with no other business.
- Imports and exports of goods.
- Shipments of goods between the mainland or the Balearic Islands and the Canary Islands, Ceuta or Melilla.
- Those you already report in another periodic return with the same data. For example, sales and services to businesses in other EU countries that go in modelo 349. Or what you pay with withholding to professionals and for your premises' rent, which already goes in your modelo 190 and your modelo 180.
What data it carries
For each client or supplier you enter their name or company name and their NIF (tax ID), the total amount for the year and its split by quarter (articles 33.1 and 34.1). Some transactions go separately, in their own record or box:
- Rent of business premises. If you are the landlord, you also enter the cadastral reference and the address of the property (article 34.1.d).
- Cash over €6.000. If the same client paid you more than €6.000 in cash during the year, you show it separately (article 34.1.h). If that payment arrives after you file modelo 347, or the cash total exceeds €6.000 later, you report it in the modelo 347 of the year it happens (article 35.5).
- Property sales subject to IVA (article 34.1.i).
- Transactions under the IVA cash accounting scheme (article 34.1.j).
- Reverse charge transactions, where the buyer declares the IVA (article 34.1.k).
Which quarter each transaction goes in
Each transaction goes in the quarter in which you must record its invoice in your IVA libros registro (article 35.1). Advance payments are declared too: when the transaction takes place, you enter the total minus what you already declared as an advance (article 35.3). If an invoice is corrected in another year or quarter, the change goes in the period in which it happens (article 35.2).
The deadline: all of February
Modelo 347 is filed during February, with the transactions of the previous year (article 10 of Orden EHA/3012/2008). If the last day falls on a weekend or public holiday, it moves to the next working day. Modelo 347 for 2026 can be filed until 01/03/2027, because 28/02/2027 is a Sunday. It is in the tax calendar.
If you miss the deadline or make a mistake
Since modelo 347 involves no payment, filing it late carries no surcharge, but it is an offence. For informative returns of this kind, the fine is €20 for each item or set of items about the same person that you should have included, with a minimum of €300 and a maximum of €20.000 (article 198.1 of the Ley General Tributaria, the General Tax Law). If you file late on your own, before Hacienda asks you to, it is halved: €10 per item, with a minimum of €150 and a maximum of €10.000 (article 198.2). That fine falls by a further 40% if you pay it on time and do not appeal (article 188.3).
If you filed it with errors, you correct it with a supplementary or replacement return (article 122.3 of the General Tax Law). Everything that happens when you are late is in surcharges and penalties for filing late.
